TERMS AND CONDITIONS

At Malik Butchers, our goal is to provide you with the best experience. It is important that you carefully read and understand the following terms and conditions before using our services. These terms outline what you can expect from us and the conditions under which you agree to be bound when placing an order.

 

Becoming a Customer

1.1 To order from us, you must be at least 18 years old, have a delivery address within our service area, and have a credit or debit card that we accept, in your name.

1.2 We reserve the right to reject any order or to terminate your account with us at our discretion.

1.3 Our Terms and Conditions will be in effect when you place your order.

 

Your Account

2.1 You have the option to create an online account with us to make future visits to our website more convenient. If you choose to do so, you will be provided with a username and password to use when placing orders with us.

2.2 You are accountable for all activity on your account. You should take care to keep your username and password confidential, and ensure that access to your computer is restricted to prevent unauthorized access to your account. If you suspect that your password has become compromised or has been or may be used without authorization, you must inform us immediately.

2.3 Please make sure the information you provide us with is accurate and up-to-date, and inform us promptly of any changes.

2.4 Please make sure that you have read our privacy policy statement.

 

Contract

3.1 This website is operated by Malik Butchers Ltd. Once you have placed an order on the website, we will confirm your order by sending an email to the email address you have provided. This email will list all products you have ordered, the price and delivery details. This is not an acceptance by us. A legally binding contract will only arise once we have completed delivery of the goods to you.

3.2 If you have provided an incorrect email address, and do not receive a purchase confirmation email, or any other details are incorrect, it is your responsibility to contact us to correct your information. We cannot be held liable for incorrect information provided by you or any spam filtration by your email service provider.

 

Amending or Cancelling your Order

4.1 The confirmation email we send will specify the latest time by which you can make changes or cancel your order. The cut-off time depends on when you placed your order. If you placed your order before 10:00AM on a specific day, you have until 10:00AM on that day to request any changes or to cancel the order. If you placed your order AFTER 10:00AM on any day, you have until 10:00AM the next day to request changes or cancel the order. The only exception to this is if you placed your order at any time on a Friday, over the weekend, or before 10:00AM on the following Monday, in which case you have until 10:00AM on that Monday to request changes or cancel the order. The reason for this is because we do not as of yet offer a weekend delivery service

4.2 If you fail to request to either amend or cancel your order by the specified cut-off time, generally before 10:00AM, your order will be processed and you will be charged in full for the value of your order, including delivery costs. This is because your order would likely have been collected by the courier for shipment. If your request to cancel your order is up to 20 minutes after the cut-off time, we suggest that you call us at 01902 429182 to confirm if your shipment has been collected by the courier or not. If it hasn’t, we can cancel your order and any associated monetary transactions will also be cancelled. If the shipment has been collected by the courier, your order will be processed and you will be charged in full for the value of your order, including delivery costs. Any cancellation/amendment request must be received by us by email, via the contact us page, clearly stating your name, your Order Number and Delivery Address, prior to the specified cut-off time, and followed up with a telephone call if the request is up to 20 minutes after the specified cut-off time.

4.3 If the items you ordered are unavailable, we will inform you and provide you with the option of receiving a replacement product with your consent, or receiving a full refund or voucher within two business days, also with your consent.

 

Price and Delivery Charges

5.1 The cost of the goods will be as stated on the website at the time of your confirmation of the order by selecting “Checkout” and will include VAT or any other applicable taxes.

5.2 The delivery fee for your order will be displayed at the time of checkout. A delivery fee of £9.95 will be applied to all orders, regardless of weight or value.

5.3 If you amend your order prior to 10:00AM, and add further items to your order, then this will not affect the amount of the delivery fee, which will remain at £9.95

5.4 The total amount of your order, including any delivery or packaging costs, will be charged to your debit or credit card when your order is collected by the courier. This will allow for any amendments you request, any items that may be out of stock or for any other unforeseen eventuality. At this point, you will be sent a further email, confirming that payment has been taken and your order has been dispatched.

5.5 Items such as minced and diced beef are priced by weight, but joints like lamb shoulders and rolled roasts may vary in weight. Additionally, processing these cuts may also result in changes in weight. Typically, the products sold are within a 10% tolerance range of the weight displayed at the time of checkout.

 

Delivery Service

6.1 We will make every effort to deliver your order within 24-48 hours of when you place it, as long as the products you have ordered are in stock.

6.2 If no one is present at the primary delivery address (specified by you at the time of placing the order) to receive the delivery, we will leave a notification that the delivery has been attempted, either at the secondary delivery address or secure location (as designated by you at the time of placing the order). That being the case, it is extremely important that you leave clear and accurate delivery instructions, during the ordering process.

6.3 Our deliveries are made with “no signature required” as the goods are perishable items. If there is no one available to receive the delivery at the primary or secondary delivery address or if you ask us to leave the goods unattended at a secure location, Malik Butchers Ltd will not be held liable for any resulting issues such as theft, tampering or contamination that may occur as a result of the delivery being left unattended.

6.4 If a delivery is refused or not accepted at the intended address, or any neighbours addresses, we will not be held responsible and will not provide a free replacement box.

6.5 Please be aware that at this time, our delivery service is only available in certain areas of mainland Great Britain and does not include Northern Ireland, the Scottish Highlands, and the Scottish islands such as Orkney, Hebridean, and Shetland Isles. Customers residing in these areas are strongly encouraged to contact us by phone at 01902 429182 before placing an order. While we may still be able to arrange a delivery, the delivery costs and times will almost certainly be longer and higher than normal.

6.6 Occasionally, events beyond our control, such as extreme weather conditions, may prevent us from delivering your goods as scheduled. In these cases, we will contact you as soon as possible to reschedule the delivery time. Our liability to you in such an event will be limited to the cost of the goods ordered and the delivery charge only.

6.7 If you prefer to place your order online and then collect it in person from our premises in Wolverhampton, then please call us on 01902 429182 us for full instructions on how to proceed, and information on when your order will be ready for collection.

 

 

In The Event Of Your Dissatisfaction

7.1 We are dedicated to providing you with the highest quality service and products. We guarantee the quality of all goods and produce you order from us. Upon receiving your delivery, please inspect the goods immediately and if you are unhappy with our service or the quality of the goods in any way, please let us know as soon as possible in writing through the feedback form in the Contact Us section of our website. You can also include pictures by sending them through the “direct mail” link. Please ensure that you include your name, your order number and delivery address

7.2 Our customer service team will review all complaints regarding our service and we will make every effort to respond to you within two working days.

7.3 Any complaints regarding the quality of the goods you receive will be directed to our quality control team for review. In order to assist with the review process, please retain the produce in question. We will make every effort to respond to you within one working day with the outcome of our findings.

7.4 Due to the perishable nature of our products, we are unable to accept returns of any goods delivered to you. However, if you are not reasonably satisfied with your order, we may, at our discretion, provide you with a Malik Butchers voucher or a full refund for the value of the goods that did not meet your expectations within three working days of receiving your complaint.

 

What We Are Not Liable For

8.1 We will not be held responsible for any indirect or resulting loss or damage, including loss of profits, that may occur due to our inability to supply the goods to you.

8.2 Our liability shall not be limited in the event of death or personal injury caused by our negligence or breach of contract, and this agreement shall not affect any legal rights you have as a consumer.

8.3 Please note that some of our products may contain traces of nuts and other allergens. To help you make an informed decision, we list all relevant information, including allergens, alongside each item on our website. However, it is your responsibility to read and understand this information before placing an order. If you need further information or have any concerns, please do not hesitate to contact us.

8.4 We will not be held responsible for any business-related losses or damages that may occur as a result of using, distributing, or reselling the goods, as these goods are intended for consumer consumption only.

8.5 Once the goods have been delivered to the specified address or secure location stated in your order, we will no longer be held liable for them.

8.6 We take care to package our products to ensure they reach you in the best condition possible, but it is your responsibility to refrigerate perishable items as soon as they are received. We will not be liable for any damage or deterioration that may occur if you or a third party moves, transports, or delivers the goods to another address after our initial delivery.

8.7 Please note that due to the handmade nature of our artisan products, weight variations may occur. We cannot guarantee the exact weight of each product and will not be held liable for any under or over-weight items. The price listed is based on the unit, not weight. Our butchers are highly trained, Master Butchers and will make every effort to meet weight expectations, however, we cannot make a guarantee in every instance.

 

General

9.1 These terms and conditions establish the complete agreement between us. Any inaction on our part to enforce any of our rights under this agreement will not affect our ability to assert those rights in the future.

9.2 We are not responsible for delays or inability to fulfil our obligations if they are caused by circumstances beyond our reasonable control.

9.3 We reserve the right to make changes to our website, policies, terms and conditions, and update prices at any time, however, this will not affect the terms and conditions and prices in effect at the time of your purchase.

9.4 We take great care to ensure that all product descriptions, images, information, and prices are as accurate as can be, however we cannot be held liable for any inaccuracies, errors, or omissions. In some cases, the colour and shape of the product may differ from what is shown on the website.

9.5 This Agreement is governed by the laws of England and Wales, and both parties hereby agree to submit to the exclusive jurisdiction of the courts of England and Wales.
